Preamble

In this document, the following capitalized terms will have the meanings specified below.

Definitions

  • TRADEMARKS: refers to registered trademarks.
  • SITE: refers to the website owned by the Seller, located at energypal.ro, through which the USER has access to information regarding the services and products offered/provided by energypal.ro.
  • SELLER/PROFESSIONAL: is actually S.C. TIMEPAL ROMANIA S.R.L., headquartered in Bucharest, sector 1, Dobrogei street, no. 1, registered with the Trade Registry under no. J40/11505/2013, with CUI RO 32250048.
  • USER: refers to the person accessing the SITE for private or professional purposes and who has accepted the TERMS AND CONDITIONS of this SITE, fulfilling all the registration process requirements.
  • ABUSIVE USE: refers to the use of the SITE in a manner contrary to industry practice, regulations, and current legislation or in any other way that may cause damage to the Seller.

The information published on the SITE consists of general information about the Seller and the products sold by them, their partners, as well as other information considered of interest by the Seller for USERS.

The information is generally made available to USERS free of charge. The Seller reserves the right to implement certain services on the SITE that will be offered to its USERS for a fee. The Seller owns all intellectual property rights over the SITE, including its design and content, as well as all trademarks registered in the name of and published on energypal.ro.

The USER is required to respect all intellectual property rights of the Seller as provided by current legislation.

The USER agrees to access and use the SITE for purposes and by means that do not constitute abusive use.

Liability for SITE Content

The Seller is not and cannot be held responsible for damages caused by errors, inaccuracies, or lack of updating of the information published or maintained on the SITE, which are not due to its fault. USERS can obtain detailed and up-to-date information via email: office@energypal.ro.

The characteristics of the products presented on the SITE are provided/put at the disposal by the manufacturers and/or suppliers, and the Seller does not assume responsibility for the accuracy of this information.

The product prices on this SITE are informative and may change without notice. The promotions presented on the SITE are valid for the mentioned period; if no period is specified, they are valid while stocks last.

All products presented on this SITE are available while physical stocks last. If the stock is exhausted, the Seller’s representative will offer alternatives by presenting other products similar in appearance and technical specifications to the ordered product whose stock is exhausted.

Additionally, images are presented on the SITE as examples, and the delivered products may differ in any way due to changes in characteristics or design, without prior notice by the manufacturers.

Non-Conformity and Consumer Rights

The consumer must inform the Seller of any lack of conformity within two months from the date they discovered it. Unless proven otherwise, any lack of conformity that appears within six months from product delivery is presumed to have existed at the time of delivery, except where this presumption is incompatible with the nature of the product or the lack of conformity.

A product cannot be considered defective solely because a more advanced similar product was later released. The Seller reserves the right to supplement and modify any information on the SITE.

Dispute Resolution

Any issues caused by the products and/or services presented on the SITE will be resolved amicably within 15 working days from the date the problem is reported in writing by the USER. Otherwise, all disputes fall under the jurisdiction of the common law courts at the Seller’s headquarters.

The Seller is not liable for any loss, costs, claims, expenses, or other liabilities if these are directly caused by non-compliance with the Terms and Conditions.

Intellectual Property and Abusive Use

The Seller owns all intellectual property rights to the SITE. The USER agrees not to use the SITE in a manner contrary to legal provisions or in any way that could cause harm to the Seller.

Communications and Commercial Messages

The Seller does not engage in or encourage sending commercial communications via email unless the recipient has explicitly agreed to such communications. Any commercial communications will comply with the following conditions:

  • Clearly identified as such;
  • Clear identification of the person or company on whose behalf they are sent;
  • Promotional offers (discounts, prizes, and gifts) clearly identified, with easily accessible terms;
  • Clear identification of contests and promotional games, with easily accessible participation conditions.

Contract and Order Cancellation

If the contract is not otherwise agreed, it is considered concluded when the User’s acceptance of the offer has reached the Seller.

The Buyer has the option to view and/or cancel the order or request changes before the delivery date. If the USER accepted and concluded the contract with the Seller, they are responsible for fulfilling their contractual obligations.

The Seller has the obligation to inform the USER by email if the delivery time of the products is extended.

In case the USER finds that the delivered products do not correspond to the agreed specifications, they have the right to request a replacement or return them within 14 days of receipt.

Modification of Terms and Conditions

The Seller reserves the right to modify the TERMS AND CONDITIONS of using the site without prior notice to the USER. The TERMS AND CONDITIONS can be accepted by the USER by checking the acceptance box when finalizing the order.
